Blogger trial in Berlin: Entenmann vs. Bartels
Thursday, April 20, 2006 at 15:50 | In Bloggers' rights, Blogosphere, Germany | 3 CommentsThis is just a brief note on the blogger trial. The trial started for four hours ago and may already be over. A blogger party has reportedley been planned in the court house cafeteria after the trial.
I first thought of putting the "Not serious" tag in this post but a trial is a serious matter even if one could think the opposite about the lawsuite. Mr Wilhelm Entenmann of Schoggo.tv has sued Mr. Marcel Bartels of Mein Parteibuch on grounds that he does not want to be linked and mentioned by Mr. Partels.
Yes, you read it right. I have yet to explore the history of mouth blather between the two gentlemen but for what I have seen so far, it is worth exploring. Looks like Mr. Entenmann at some point got fed up and wanted to pull off. So he chose to sue Mr Bartels.
As I have other things at hand right now (the real life, you know) I will return to the topic later tonight. Meanwhile, you will propably have a chance read about the outcome in Marcel's Parteibuch. If you read German you will find a legal evaluation of the case in RA-Blog by Mr. Thomas Klotz.
Update: Marcel is back from court and tells what happened. The title of his post says it all: quick and painless. If you cut the legal cheese, the judge basically threw the case out.
Thomas Klotz comments in RA-Blog that the fact that Mr. Entenmann refused to pull back the lawsuite may suggest to one or both of two things: his legal costs are covered by an insurance and/or he wants to leave the door open for an equally unsuccesful appeal.

yes, one has to see history of their relationship. Laws about cyberspace or atleast public’s knowledge about them is not too extensive. Unless marcel was criminal or something, or was somehow causing loss of business to the other guy its difficult to understand why that guy filed a case.
Regardin the post you promised, i know you haven’t forgotten. I wasn’t complaining, only wondering. And i’m in no hurry. Of course you have to have a context to put it into.
and spending time on internet was a compliment

[...] Also about a month ago, Jens Knoblich in Strausberg published this post in his blog Krambox. He quoted Callboy Torsten’s announcement that any undesired link to his site would be sued for 250 euros a day. Jens was referring to the court ruling in the case Wilhelm Entenmann vs. Marcel Bartels where the court basically threw out Mr. Entenmann’s lawsuite that seeked to ban Marcel from linking to his site.
