Dirk Meyer of Hattersheim
Wednesday, April 26, 2006 at 4:54 | In Bloggers' rights, Blogosphere, Germany, crime | 2 CommentsThis is an update to my post German legislation sucks where I told about the phone call that Marcel Bartels received on Monday afternoon. On Tuesday, Marcel received another call from the same person, presenting himself as Dirk Meyer. Unlike Marcel, I am not bound by the German legislation which is why I am able to publish his full name and address Landwehrstr. 4, Hattersheim, Germany. That information is readily available in the web.
According to Marcel, Mr. Meyer told him on Tuesday that he has instructed his lawyer to seek a court order to delete the blog post of March 26 describing the questionable suing practises of Dsquared Ltd. However, that is the least interesting part of the phone call. Marcel also writes that Mr. Meyer told him that unless the post was deleted, he could expect a visit from Support 81, also known as the Hell's Angels.
Within minutes of the first call on Monday, several comments were added to Marcel's first post about Dsquared Ltd from IP 84.58.4.171 which would geographically fit with the established whereabouts (Marcel called back to a fixed network number) of Mr. Meyer at the time. I saw those comments (and made private copies of them) before Marcel deleted them. They were highly abusive and contained insulting remarks against another blogger. After the second call on Tuesday another comment from the same IP appeared to the post where Marcel describes the first call. That comment threatens Marcel with a visit by the "Support 81".
In light of these latest developments, Marcel writes in a fresh post that he has written a complaint to the district attorney's office in Wiesbaden asking them to start an inquiry on illegal threat and libel. I am not suggesting that Mr. Dirk Meyer of Landwehrstr. 4, Hattersheim would be engaged in criminal or illegal activities. That would be a conclusion I am leaving for competent law enforcing authorities. His methods of protecting a trade mark (which is by the way contested) rise more than a few questions, though.
